PUBLIC NOTICE - CHANGE IN SERVICES DUE TO COVID-19 June 21, 2021

Effective June 21, 2021

 COVID-19 protocols are as follows:

  • All persons are required to wear face coverings when conducting business at the court.
  • Most hearings in Criminal cases are livestreamed to the Court’s YouTube channel at https://www.stanct.org/node/4199553 

 Please do not come to court if you are sick or have a temperature. 

COURT CLERK’S OFFICES

  • Clerk’s Offices will be open from 8:15 a.m. to 4:00 p.m.
    • Phone services are available at (209) 530-3100; follow prompt to specific division
  • Drop Boxes are available Monday through Friday from 8:15 a.m. to 4 p.m.

    • Family Law – 1100 I Street, Modesto
    • 801 10th Street, 4th Floor, Modesto
    • Traffic – 2600 Floyd Ave, Modesto

TRAFFIC

 

CIVIL AND PROBATE

  • All Civil and Probate hearings are now being conducted in person, however, parties may still appear remotely for most matters, as follows:
    • All Civil Case Management Conferences, Law and Motion, and Ex Parte hearings are being conducted in person.  Parties and counsel may appear remotely. 
    • All Probate and Trust petition hearings, Law and Motion and Ex Parte hearings are being conducted in person. Parties and counsel may appear remotely.  
    • Court trials and related settlement conferences are being conducted in person. In order to appear remotely for a trial or other evidentiary hearing, all parties must agree to do so.
    • Civil Harassment Restraining Orders (including Workplace Violence Restraining Orders) are being conducted in person. No remote appearance option is available.
    • Orders for Examination are being conducted in person. No remote appearance option is available.
    • Claims of Exemption are being conducted in person.  Parties and counsel may appear remotely.
    • Minor’s Compromises are being conducted in person.  Parties and counsel may appear remotely.
    • Probate guardianships are being conducted in person. Parties and counsel may appear remotely.

 CONSERVATORSHIPS 

  • LPS hearings will continue to be conducted by video conference (Zoom) with Department 25.

 

UNLAWFUL DETAINERS (Landlord-Tenant Disputes)

Unlawful detainer matters in Department 19 will be heard as follows:

  • Law and motion hearings will be heard as scheduled and personal appearance will be allowed.  Parties wishing to appear telephonically should contact the Clerk’s Office at (209) 530-3100 to arrange for remote appearance.
  • Status conference and Court’s motions to dismiss will be heard as scheduled and personal appearance will be allowed.  Parties wishing to appear telephonically should contact the Clerk's Office at (209) 530-3100 to arrange for remote appearance. 
  • Trials will be heard as scheduled and personal appearance will be allowed.  Parties wishing to appear telephonically should contact the Clerk’s Office at (209) 530-3100 to arrange for remote appearance. 

SMALL CLAIMS

  • Small claims trials will be heard subject to the following:
    • The Court will stagger small claims trial starting times in thirty (30) minute intervals.  Each case will be assigned a time slot, beginning with 9:30 a.m.  For cases that were previously set at 8:30 a.m., a notice confirming the new date and time slot assigned to the trial will be sent to each party by mail.
    • Parties unable to attend trials for any reason, including COVID-19 health concerns, should file a request to postpone their trial on Judicial Council form SC-150 at least five (5) days prior to the trial.  If you are feeling sick on the day of your hearing, please do not appear at court.  Contact the Turlock Clerk’s Office at (209) 530-3100, the Court will continue your hearing and mail notice of the new hearing date to all parties.
    • Parties wishing to appear telephonically should contact the Clerk’s Office at (209) 530-3100 to arrange for remote appearance.

JUVENILE JUSTICE/DEPENDENCY

  • All non-contested Dependency matters will be heard remotely.
  • Non-contested Juvenile Justice matters will be held remotely, unless the minor wishes to appear in-person.
    • In all juvenile proceedings, if a party who has a legal right to be present cannot appear virtually, the Court will make arrangements either for their in-person or telephonic appearance. 
  • With the consent of all participants, the Court will conduct contested hearings remotely.
    • All other contested hearings will be heard in-person, with an option for parties to appear remotely.

FAMILY LAW

  • Economic Hearings
    • Economic Hearings may be conducted in-person or remotely by telephone conference call depending on requests of the parties and needs of the Court.
  • Child Custody Recommending Counseling hearings (Mediation) will continue to be conducted by conference call.
    • The Court will provide written notice of the hearing, along with call-in instructions.
  • Settlement Conferences are being held in-person, although parties may request to appear telephonically.
  • Unless otherwise ordered by the Court, Case Management Conferences will be continued by minute order.
  • Contested hearings will be conducted by video conference (Zoom), or as otherwise ordered by the Court.
    • The Court will provide written notice of the hearing, along with instructions regarding the Zoom session.

GUARDIANSHIP

  • All short cause matters are heard in-person unless parties request to appear by phone
    • Attorneys and parties shall meet and confer prior to court to expedite hearings

CONSERVATORSHIPS 

  • LPS hearings will continue to be conducted by video conference (Zoom)
  • Effective February 1, 2021 Probate Conservatorship have been transferred to the Civil Division

DCSS

  • DCSS calendar continues to be heard telephonically
    • DCSS will contact litigants prior to hearing date to confirm telephonic information

 SELF-HELP CENTER

  • Services will be provided by email and phone Monday through Friday 8 a.m. to 4:00 p.m.
